Previously, the rule was that you needed to close on the home before December 1, 2009. On November 6, 2009, Congress voted to extend the credit program (however, the rules are slightly different).&lt;br /&gt;&lt;br /&gt;Below is an article excerpted from the IRS website:&lt;br /&gt;&lt;br /&gt;----------&lt;br /&gt;&lt;br /&gt;If you are in the market for a new home, you may still be able to claim the First-Time Homebuyer Credit. Congress recently passed The Worker, Homeownership and Business Assistance Act Of 2009, extending the First-Time Homebuyer Credit and expanding who qualifies.&lt;br /&gt;&lt;br /&gt;Here are the top 10 things the IRS wants you to know about the expanded credit and the qualifications you must meet in order to qualify for it.&lt;br /&gt;&lt;br /&gt;1.  You must buy – or enter into a binding contract to buy a principal residence – on or before April 30, 2010.&lt;br /&gt;&lt;br /&gt;2.  If you enter into a binding contract by April 30, 2010 you must close on the home on or before June 30, 2010.&lt;br /&gt;&lt;br /&gt;3.  For qualifying purchases in 2010, you will have the option of claiming the credit on either your 2009 or 2010 return.&lt;br /&gt;&lt;br /&gt;4. A long-time resident of the same home can now qualify for a reduced credit. You can qualify for the credit if you’ve lived in the same principal residence for any five-consecutive year period during the eight-year period that ended on the date the new home is purchased and the settlement date is after November 6, 2009.&lt;br /&gt;&lt;br /&gt;5.  The maximum credit for long-time residents is $6,500. However, married individuals filing separately are limited to $3,250.&lt;br /&gt;&lt;br /&gt;6. People with higher incomes can now qualify for the credit. The new law raises the income limits for homes purchased after November 6, 2009. The full credit is available to taxpayers with modified adjusted gross incomes up to $125,000, or $225,000 for joint filers.&lt;br /&gt;&lt;br /&gt;7. The IRS will issue a December 2009 revision of Form 5405 to claim this credit. The December 2009 form must be used for homes purchased after November 6, 2009 – whether the credit is claimed for 2008 or for 2009 – and for all home purchases that are claimed on 2009 returns.&lt;br /&gt;&lt;br /&gt;8.  No credit is available if the purchase price of the home exceeds $800,000.&lt;br /&gt;&lt;br /&gt;9. The purchaser must be at least 18 years old on the date of purchase. For a married couple, only one spouse must meet this age requirement.&lt;br /&gt;&lt;br /&gt;10. This is a HUGE MISTAKE. Planning now may save you hundreds on your tax return and save time in getting your refund.&lt;br /&gt;&lt;br /&gt;Steps to take with year-end tax planning: &lt;br /&gt;1. Save your final paycheck stub(s): This will allow you to get your tax return started without waiting for W-2's. &lt;br /&gt;&lt;br /&gt;2. Make an extra house payment: You can take a tax deduction on the interest portion of the extra payment. &lt;br /&gt;&lt;br /&gt;3. Make an extra contribution to a QUALIFIED retirement plan or get one started: You can deduct the amount of taxable income on your return by the amount you contribute to qualified plans.&lt;br /&gt;&lt;br /&gt;4. The announcement generated so much confusion that its chief, Commissioner Douglas Shulman, clarified that the agency is not "cracking down" on employer-provided cell phones. Shulman also asked Congress to reform the recordkeeping rules for employer-provided cell phones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Special recordkeeping rules&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;In 1989, the IRS imposed strict recordkeeping rules to show business use of employer-provided cell phones. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;If the cell phone is used exclusively for business, all use is excludable from the employee's income (as a working condition fringe benefit). Any amount that represents personal use is included in the employee's wages. This includes individual personal calls, as well as a pro rata share of monthly service charges. Today, cell phones are much more economical and their use is widespread. Additionally, most cell phone plans today charge by time and not by distance. The IRS would treat the remaining percentage as personal use. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;Many media outlets erroneously reported that the IRS intended to automatically treat 25 percent of the use of an employer-provided cell phone as personal use. The IRS merely suggested 25 percent as a possible amount. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Statistical sampling method.&lt;/b&gt; Another method would measure an employee's personal use of an employer-provided cell phone by statistical sampling techniques. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Legislation&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;The IRS's announcement seemed to cause more confusion that clarity. Many print, broadcast and internet news sites reported that the IRS planned to increase audits of employers. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;In response, Shulman said that the IRS is not "cracking down" on employers. Rather, the agency's proposals are designed to eliminate uncertainty for businesses and employees. "The current law, which has been on the books for many years, is burdensome, poorly understood by taxpayers, and difficult for the IRS to administer," Shulman said.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt; &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p class="MsoPlainText"&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;Shulman urged Congress to ease the recordkeeping rules for employer-provided cell phones. "I ask that Congress act to make clear that there will be no tax consequence to employers or employees for personal use of work-related devices such as cell phones provided by employers." If you are searching for a job this summer, you may be able to deduct some of your expenses on your tax return.&lt;/p&gt;  &lt;p&gt;Here are the top six things the IRS wants you to know about deducting costs related to your job search.&lt;/p&gt;  &lt;ol&gt;&lt;li&gt; &lt;div&gt;In order to deduct job search costs, the expenses must be spent on a job search in your current occupation. You may not deduct expenses incurred while looking for a job in a new occupation.&lt;br /&gt;&lt;br /&gt;&lt;/div&gt; &lt;/li&gt;&lt;li&gt; &lt;div&gt;You can deduct employment and outplacement agency fees you pay while looking for a job in your present occupation. If your employer pays you back in a later year for employment agency fees, you must include the amount you receive in your gross income up to the amount of your tax benefit in the earlier year.&lt;br /&gt;&lt;br /&gt;&lt;/div&gt; &lt;/li&gt;&lt;li&gt; &lt;div&gt;You can deduct amounts you spend for preparing and mailing copies of a résumé to prospective employers as long as you are looking for a new job in your present occupation.&lt;br /&gt;&lt;br /&gt;&lt;/div&gt; &lt;/li&gt;&lt;li&gt; &lt;div&gt;If you travel to an area to look for a new job in your present occupation, you may be able to deduct travel expenses to and from the area. You can only deduct the travel expenses if the trip is primarily to look for a new job. And how do I calculate self-employment taxes?&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;When you are employed by someone, they are already deducting social security and medicare taxes for you.  As an employee, you pay only half of the taxes owed for Social Security and Medicare (6.2% SS &amp;amp; 1.45% Medicare). Your employer pays the other half on your behalf, for a total of 12.4% Social Security and 2.9% Medicare. When you are self-employed, you alone are responsible for the entire amount.&lt;br /&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;Individuals with $400 or more of net earnings from self-employment must pay self-employment tax, in addition to any income tax imposed on the same income. This article can help you estimate any self-employment tax liability that you may owe.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p style="font-weight: bold;"&gt;&lt;span style=";font-family:ARIAL;font-size:130%;"  &gt;&lt;span style="font-family:ARIAL;"&gt;Self-employment tax&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;The self-employment tax consists of two taxes: a tax used to fund Social Security benefits and a tax used to fund Medicare benefits. When you are an employee, you pay half of this tax and your employer pays the other half.  When you are self-employed, you are responsible for the full amount. The Social Security tax rate is 12.4 percent, and the Medicare tax rate is 2.9 percent. The combined tax rate is 15.3 percent. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;The first $106,800 (for 2009) of net income from self-employment (reduced by any wages received by the individual) is subject to a 15.3 percent tax (which includes the Social Security and Medicare health insurance taxes). Income above that amount is only subject to a 2.9 percent Medicare tax. Taxpayers use Schedule C or C-EZ (Form 1040) to figure net earnings from self-employment (self-employment income). Schedule SE (Form 1040) is used to figure and report self-employment taxes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p style="font-weight: bold;"&gt;&lt;span style=";font-family:ARIAL;font-size:130%;"  &gt;&lt;span style="font-family:ARIAL;"&gt;Calculating self-employment tax liability&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Step1.&lt;/i&gt;&lt;/b&gt; Determine your net income from self-employment (from Schedule C or C-EZ for sole proprietors; from Schedule E for self-employed businesses treated as a partnership; or Schedule F for farmers). Generally, net income is your total business receipts minus your total business deductions.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Step 2.&lt;/i&gt;&lt;/b&gt; Multiply your net income from self-employment by 0.9235 (or 92.35 percent). This is your net earnings from self-employment (self-employment income). If this number is less than $400, you do not owe self-employment tax.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Step 3.&lt;/i&gt;&lt;/b&gt; Multiply by 0.153 (or 15.3 percent) the amount of your net earnings up to an amount equal to $106,800 reduced by any wages received (for which there has already been withholding). Additionally, if applicable, multiply any net earnings over $106,800 by 0.029 (or 2.9 percent). Add these two numbers together. This is your estimated self-employment tax liability.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Step 4.&lt;/i&gt;&lt;/b&gt; Report your self-employment tax liability on Schedule SE of Form 1040.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Example.&lt;/i&gt;&lt;/b&gt; Your Schedule C shows net business income of $225,000. Your net earnings from self-employment (self-employment income) is $207,787.50 ($225,000 x 0.9235 = $207,787.50). The first $106,800 (assuming no wage income) gets taxed at a maximum rate of 15.3 percent ($106,800 x .153 = $16,340.40). The remaining $100,987.50 is taxed at 2.9 percent ($100,987.50 x .029 percent = $2,928.60). Putting your child on your payroll is a smart move that can save you money in taxes ... and get your child involved in the family business!&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Deductible business expense&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;The wages you pay your child are tax deductible on your income tax return (or that of your business) as business expenses. As a general rule, a business can claim a tax deduction for the salary, wages, commissions, bonuses, and other compensation it pays to its employees. Don't forget a W-2 for your child at the end of the year, either.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;How much is too much?&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;If you are putting your child on the payroll, be careful how much you pay him or her in wages since the IRS requires that you child be paid a reasonable amount for the labor provided. Generally, the IRS does not challenge the amount of the compensation as unreasonable unless, among other things, the employee has a personal relationship with the employer. Translation: if your daughter is bussing tables and sweeping floors, paying her $25 per hour will likely be deemed "excessive" by the IRS. The IRS in these cases is not only concerned about "no show" jobs but also those paid at an unreasonable salary level. Proof, in the form of time logs and comparable salary levels in the industry, will go a long way in helping keep the deduction should the IRS audit this aspect of your business.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Standard deduction&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;Due to the standard deduction for 2009, the first $5,700 of your child's wages would not be taxed at all. Your child, however, can not also take a personal exemption deduction if you are claiming her as a dependent. For example, if you file a Schedule C, Profit or Loss From Business, the $5,700 you pay your child, which is non-taxable to her, reduces your Schedule C income by that amount. If you are in the 35 percent tax bracket, the deduction will save you $1,881 in federal income taxes and at no tax cost to your child. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;&lt;i&gt;Comment.&lt;/i&gt;&lt;/b&gt;  The actual computation of a child's standard deduction is filled with a number of limitations so that investment income cannot be unnecessarily sheltered by a child. For tax years beginning in 2009, the standard deduction for a dependent may not exceed the greater of $950, or the sum of $300 and the dependent's earned income (up to the regular standard deduction amount). The threshold for the application of the kiddie tax is twice the amount of the limited standard deduction for a dependent, or $1,900. Earned income is not subject to the kiddie tax.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;Limited withholding responsibilities for Social Security or Medicare taxes &lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;The wages you pay your child (as long as they are under the age of 18) may not be subject to Social Security or Medicare taxes, or state disability/unemployment taxes. This exemption is specifically provided for in the Internal Revenue Code. "Employment" for purposes of Social Security and Medicare taxes (FICA) generally excludes services performed by a child under the age of 18 in the employ of his or her parent if the parent's trade or business is a sole proprietorship or a partnership in which each partner is a parent of the child.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;However, the wages you pay your child for services are subject to income tax withholding, as well as social security, Medicare, and FUTA taxes if your business is:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;ul&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;li&gt;A corporation, even if it is controlled by you or your spouse;&lt;/li&gt; &lt;li&gt;A partnership, unless each parent is a partner;&lt;/li&gt; &lt;li&gt;A partnership, even if the child's spouse is a partner;&lt;/li&gt; &lt;li&gt;An estate, even if it is the estate of a deceased parent.&lt;/li&gt;&lt;/span&gt;&lt;/span&gt;&lt;/ul&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;Moreover, children under the age of 21 are exempt from Federal Unemployment Tax (FUTA), whether or not in a trade or business.. But remember, you will still need to withhold federal income tax and file a W-2 form for each of your children you employ.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;IRA contribution&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;You may be able to shelter an additional 15 percent of wages (up to $5,000) by contributing to an IRA for your child. A contribution to a regular IRA is deducted from income. This strategy works even better with a Roth IRA. Although contributions to a Roth IRA are not deductible, the wage income allows your child to make contributions. Those amounts grow tax-free as long as your child keeps the account.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;b&gt;What about the "kiddie tax?"&lt;/b&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt; &lt;p&gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;&lt;span style=";font-family:ARIAL;font-size:85%;"  &gt;If you are worried about the effect of the dreaded "kiddie tax," relax. The "kiddie tax" does not apply to your child's "earned" income - which is any income your child earns from working, as opposed to "unearned" investment-type income. Well-organized records will make preparing your tax return a breeze. Also, if you are selected for an IRS audit, your records will be your saving grace. They will look for consistency and accuracy in your books to prove what your returns have documented. They will also want to see proof of business transactions. Keep your receipts, check stubs, bank statements, deposit slips, employment records, and all other transactions for as long as the statute of limitations exists.
